2. Description of Service

Meshnexa provides an online educational platform offering group sessions, individual lessons, personalized learning paths, and live interaction with instructors. The Service enables students to access educational content and participate in online learning activities.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

3. User Accounts

• Introduce any viruses, malware, or other malicious or technologically harmful material

• Attempt to gain unauthorized access to any portion of the Service or any other systems or networks

• Harass, abuse, or harm another person or engage in disruptive behavior

• Share, distribute, or reproduce any content from the Service without authorization

5. Intellectual Property Rights

5.1 Our Content

The Service and its entire contents, features, and functionality including but not limited to all information, software, text, displays, images, video, audio, course materials, design, selection, and arrangement are owned by Meshnexa, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

5.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial educational purposes. This license does not include any right to resell or commercial use of the Service or its contents, any downloading or copying of account information, or any use of data mining or similar data gathering tools.

5.3 User Content

You retain ownership of any content you submit, post, or display on or through the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, perform, display, distribute, and otherwise disclose such content in connection with operating and providing the Service.

6. Educational Services

6.1 Course Enrollment

When you enroll in a course or program, you agree to participate according to the course requirements and schedule. Course availability, instructors, and curriculum are subject to change without notice.

6.2 Live Sessions

Participation in live group or individual sessions requires appropriate technology and internet connectivity. We are not responsible for technical difficulties that prevent your participation.

6.3 Academic Integrity

You agree to maintain academic integrity and honesty in all educational activities. Cheating, plagiarism, or other forms of academic dishonesty may result in immediate termination of your access to the Service.

7. Payment and Fees

7.1 Pricing

Certain features of the Service require payment of fees. All fees are quoted in the applicable currency and are subject to change with notice. You agree to pay all applicable fees for services you purchase.

7.2 Payment Processing

Payments are processed by third-party payment processors. You agree to comply with their terms and conditions. We are not responsible for any errors or issues arising from payment processing.

7.3 Refund Policy

Refund eligibility and conditions are specified separately in our Refund Policy. Unless otherwise stated, all sales are final.

7.4 Subscription Services

If you purchase a subscription, your subscription will automatically renew at the end of each subscription period unless you cancel before the renewal date. You authorize us to charge your payment method for renewal fees.

The Service is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

10.2 No Guarantee of Results

We do not guarantee any specific educational outcomes, results, or achievements from your use of the Service. Your success depends on multiple factors including your own effort, dedication, and circumstances.

10.3 Service Interruptions

We do not warrant that the Service will be uninterrupted, timely, secure, or error-free. We do not warrant that the results obtained from the use of the Service will be accurate or reliable.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Meshnexa and its officers, directors, employees, agents, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your access to or use of or inability to access or use the Service

• Any conduct or content of any third party on the Service

• Any content obtained from the Service

• Unauthorized access, use, or alteration of your transmissions or content

In no event shall our total liability to you for all damages, losses, or causes of action exceed the amount you have paid to us in the twelve months prior to the claim, or one hundred dollars, whichever is greater.

12. Indemnification

You agree to defend, indemnify, and hold harmless Meshnexa and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees including reasonable attorneys' fees arising out of or relating to your violation of these Terms of Use or your use of the Service.

13. Dispute Resolution

13.1 Informal Resolution

If you have any dispute with us, you agree to first contact us and attempt to resolve the dispute informally by contacting us at info@meshnexa.sbs.

13.2 Binding Arbitration

If we cannot resolve the dispute informally, any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify.

13.3 Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between you and us individually. You agree to waive any right to have any dispute brought, heard, or arbitrated as a class action, collective action, or representative action.

14. Governing Law

These Terms of Use shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. You agree to submit to the personal jurisdiction of the courts located within the applicable jurisdiction for the purpose of litigating all such claims or disputes.

15. Termination

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

If any provision of these Terms of Use is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

These Terms of Use, together with our Privacy Policy and any other legal notices published by us on the Service, shall constitute the entire agreement between you and Meshnexa concerning the Service.

18. Waiver

No waiver by Meshnexa of any term or condition set forth in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
